The Terms and Conditions of Use of the website www.nauzjewellery.com that the sole proprietor Manuel Pina Cruz makes available to his potential clients, as well as the conditions applicable to contracts concluded through that web platform, are as follows:

1.1 The 'site' or 'portal' www.nauzjewellery.com (hereinafter referred to as the 'site') is a website owned by the sole proprietor Manuel Pina Cruz (better identified below in these General Terms and Conditions), which uses the NAUZ brand and owns the domain name "nauzjewellery.com".
1.2 For the purposes of complying with the applicable legal provisions, the full identification and obligatory references of the owner of the website and supplier of the products offered to the public through it are as follows:

1.3 For the purposes of the legislation on the protection of personal data (Law 67/98, of October 26), Manuel Pina Cruz, an individual entrepreneur, is the entity responsible for the processing of personal data provided by users of the site.
2. Object, objectives and scope
2.1. The website is a web-based electronic platform for the promotion, dissemination and sale to the public ("virtual store") of jewellery products marketed by Manuel Pina Cruz.
2.2 These general terms and conditions apply to all visitors and users of the www.nauzjewellery.com website and to all commercial transactions carried out through the aforementioned platform ("Virtual Shop").
2.3 The sole proprietor Manuel Pina Cruz reserves the right to amend these general terms and conditions at any time. Any changes to these general terms and conditions will come into force immediately, and the conditions in force on the date the user placed the order will apply, provided that payment has been made.
2.4 These Terms and Conditions specifically and exclusively regulate transactions and operations carried out through the website.
3. Registration
In order to make purchases through the site, you must register as a Customer by creating a personal account and filling in the appropriate form.
Once registered, all you have to do is insert all the items you wish to purchase into the virtual shopping basket.
You must follow all the steps of the purchase in order for it to be completed successfully.
As soon as you complete your purchase, you will receive an automatic email confirming the transaction. If your details are not correct, you can immediately ask for them to be changed, or even for your purchase to be canceled.
Deliveries of products ordered in the online store will be made in mainland Portugal.
Validation of the purchase order implies that the Customer has read and expressly accepts these General Conditions of Contract and Use, available for consultation on the Website.
The data recorded by the sole proprietor Manuel Pina Cruz constitutes proof of all the transactions carried out between him and the Customer. It is the responsibility of the sole proprietor Manuel Pina Cruz to file the electronic document formalizing the contract and keep it accessible, and it will be kept for the purposes associated with the commercial transactions that have taken place. Purchase and sale contracts made through the website can be concluded in Portuguese or English.

5. Product and Price Information
5.1. Product Information
On the website, each product listed and offered for sale is duly identified by its name or sales denomination, an image and the corresponding sales price. Items made of precious metal, whether gold or silver, are duly stamped in compliance with the rules laid down in the Legal Framework for Goldsmiths and Assay Offices (RJOC). If the customer is in any doubt as to the authenticity of the products, he may use the services of the Assay Offices for verification purposes.
5.2 Price Information
The prices of the products listed on the site are in euros and include VAT.
Manuel Pina Cruz reserves the right to change prices at any time. However, he undertakes to apply the rate and prices indicated at the time the purchase order is placed.
In the event of a computer error, or from any other source, which causes a substantial change not foreseen by Manuel Pina Cruz in the retail price of the product, such that it becomes exorbitant or manifestly derisory, the purchase order will be considered invalid and cancelled.
5.3 Shipping costs and delivery times
The delivery method made available by the sole proprietor Manuel Pina Cruz to buyers will be via the CTT and MRW service and the Express service. Both the delivery method and the delivery time may change depending on the time of year.

The costs of the shipping service are borne by the sole proprietor Manuel Pina Cruz, for orders to be placed within mainland Portugal and the archipelagos of the Azores and Madeira.

5.3.B Delivery times
On the product sheet you will find the estimated date of dispatch: 3 working days for deliveries in mainland Portugal and 4 to 6 working days for deliveries in the Autonomous Regions of Madeira and the Azores. 2 weeks. Delivery times are indicative and are therefore considered valid when there are no physical or structural impediments (e.g. incorrect addresses or force majeure). In addition to the estimated shipping time, transportation time depends on the carrier chosen and the destination of the order.
5.4 Product availability
The sole proprietor Manuel Pina Cruz only processes an order placed by a Customer after confirmation of payment, and therefore cannot guarantee the availability of items until such time as processing begins.
Manuel Pina Cruz only ships on working days. Therefore, neither weekends nor public holidays are taken into account when estimating the delivery of orders.
Estimated delivery dates are merely indicative. In addition to the estimated shipping time, there is also transportation time, which depends on the carrier and the destination of your order.
All promotional campaigns have limited stock and are exclusively for online sale. If any of the goods ordered are found to be out of stock, Manuel Pina Cruz may cancel the order and reimburse the customer for all sums paid.
Any delay in the dispatch of items in relation to the estimated dates shown, which are merely indicative, does not entitle the customer to any compensation.
Deliveries are made in person and require physical presence at the time of receipt. The customer must ensure that they meet the conditions for their order to be delivered. Each shipment is accompanied by the following documents:
. Certificate of Authenticity;
. Detailed invoice.
The Customer has the right, upon receipt of his order, to open the packaging to check that the product is in accordance with what was ordered and that it has no external defects. Manuel Pina Cruz will be obliged to refuse any request for a refund or replacement (right of withdrawal) for products with external defects that have been accepted by Customers at the time of delivery. The right of withdrawal shall remain valid for technical problems detected by the Customer after delivery and in accordance with the terms laid down by law. If the Customer detects any anomaly in the item purchased and it does not meet their expectations, they can return it by sending an email within 24 hours indicating the problem to Customer Service at info@nauzjewellery.com.
6. Cancellations, exchanges and returns, product guarantees and after-sales assistance
6.1 Right of withdrawal
Having purchased an item through the Site, the user has a period of 14 days to return it, from receipt of the order, under the terms of the right of free resolution, provided for in Decree-Law no. 24/2014, of February 14. You may do so provided that the following conditions are met:
Presentation of the product purchase invoice.
The product must be delivered in the same condition as it was sold - no scratches, no external damage or signs of use and in perfect condition.
To do this, the Customer can contact info@nauzjewellery.com, who will provide all the information on the exchange process. Under no circumstances should the Customer send items to Manuel Pina Cruz without having made prior contact, as they will not be received.
Contracts for the supply of personalized goods are excluded from the Right of Free Resolution within the 14 days indicated.
In order to exercise their right of withdrawal, the Customer must notify the contact indicated on the Website of their decision to withdraw from this contract by means of an unequivocal statement (e.g. letter sent by post or email).
If the right of withdrawal is exercised, the Customer will bear the full cost of returning the goods, with the exception of those that cannot be returned by ordinary post.
6.2 Return process
The Customer must return the goods without undue delay and no later than 14 (fourteen) days from the day on which he informed the sole proprietor Manuel Pina Cruz of the free termination of the contract, which is deemed to have been respected if the Customer returns the goods before the expiry of this 14 (fourteen) day period.
After contacting us and being given instructions on how to return the goods, you can send the item duly packed in its original packaging to our address:

All items will be checked on arrival at our service and will only be accepted for exchange or return if they comply with the return conditions.
Refunds will only be made once the condition of the product has been checked.
The customer will bear the cost of returning the product.
In the event of a return, if the Customer opts for a refund, the sole proprietor Manuel Pina Cruz informs that:
The refund will be made by the same means of payment.
In the case of payment by ATM, Manuel Pina Cruz asks the Customer to provide a NIB so that the return can be made more quickly.
In the event that you have received damaged items, Manuel Pina Cruz will arrange for them to be collected from the location you indicate, in the same area as the original order, at no cost to you.
6.3 Refunds
In the event of termination of the contract, the Customer will be refunded the payments made, without undue delay and, in any event, no later than 14 (fourteen) days from the date on which Manuel Pina Cruz is informed of the Customer's decision to terminate this contract.
In order to speed up the reimbursement process, in the case of amounts paid by Credit Card and Multibanco with the associated NIB/IBAN, the reimbursement will be made to the same means of payment. In the case of amounts paid by Mbway, the refund will be made to the same associated telephone number.
Manuel Pina Cruz, a sole proprietor, hereby informs you that he may withhold reimbursement until he has received the returned goods, or until the customer provides proof that the goods have been sent, whichever comes first.
6.4 Cancellation of orders
The Customer may cancel their order at any time up until its delivery, with the right to a refund of the amount paid.
Failure to pay for the order within 2 days of the date on which it was definitively placed will result in its automatic cancellation.
Under the terms of Decree-Law no. 7/2004 of January 7 (as amended by Decree-Law no. 62/2009 of March 10 and Law no. 46/2012 of August 29) on electronic commerce, the sole proprietor Manuel Pina Cruz reserves the right to unilaterally cancel the order whenever there is a programming error, a malfunction in the computers of the sole proprietor Manuel Pina Cruz as well as if the contractual proposal arrives deformed at its destination and the error concerns an essential element of the contract.
6.5 Consumer goods warranty and after-sales service
All products sold through the site are covered by a legal guarantee of two years from the date of purchase by the User/Customer.
In order to exercise the rights arising from the guarantee, the User / Customer must always present the respective sales invoice.
They will not be repaired or replaced under the guarantee, as they are excluded from it:
Products that show signs of misuse, improper handling or use contrary to the instructions. This includes, but is not limited to, products that show signs of falling or accidents;
That have undergone unauthorized modifications and/or repairs;
Quick-wear accessories that accompany the products.
The provisions of these conditions regarding guarantees in consumer sales do not prejudice or affect the consumer's rights established in Decree-Law 67/2003, of April 8, as amended by Decree-Law 84/2008, of May 21.
If, for any reason, the product is not covered by the warranty but the fault is repairable, Manuel Pina Cruz will contact the User/Customer and submit a repair estimate for prior approval by the Customer.
7. Information on the Right of Free Resolution (referred to in Article 4(1)(j) of Decree-Law no. 24/2014, of February 14, as amended by Law no. 47/2014, of July 28)
The consumer has the right to freely withdraw from this contract within 14 calendar days, without having to give any reason.
The period for exercising the right of withdrawal expires 14 calendar days from the day following the day on which you acquire or a third party indicated by you, other than the carrier, acquires physical possession of the goods. In order to exercise your right of withdrawal, you must notify us via the contact details below of your decision to withdraw from this contract by means of an unequivocal statement (e.g. letter sent by post, fax or email).

In order for the withdrawal period to be respected, it is sufficient for your communication regarding the exercise of the right of withdrawal to be sent before the withdrawal period expires.
8. Applicable legislation.
Portuguese law shall apply to the use of the site, as well as to transactions, contracts and business concluded through it, and to the interpretation and application of these general conditions.
The Portuguese Courts shall have exclusive jurisdiction to settle any dispute arising from the use of the site, transactions, contracts and business concluded through it or the application of these general conditions.
